Identify the disputed fact, relevant dates, people, accounts, devices and applications. Separate known facts from assumptions.

Preserve before examining

Secure original devices and native files. Avoid opening, forwarding, exporting or “cleaning up” potentially relevant material.

Provide context

Supply pleadings, timelines, known identifiers, communication details and any prior technical reports that define relevance.

Agree deliverables

Confirm whether the matter requires a preliminary assessment, expert report, affidavit, consultation or testimony.

Maintain independence

The expert should report findings and limitations objectively, including results that do not support the instructing party’s theory.
